E-Verify
What you need to know
As an employer, we've all heard the term E-Verify. Some of us are already using this system, some of us aren't, and there are those out there who are still confused about this federal program. In simplified terms, E-Verify is the name of the federal worker verification system that helps employers determine the eligibility of their employees to work in the United States. The program was authorized by the Illegal Immigration Reform and Responsibility Act of 1996. It's the best method for employers to ensure that they have a legal work force. The program is free to employers, and while it's still voluntary, federal employers, and some states, require it.
How does it work? The first thing an employer needs to do is enroll in the program. It's important that you know whether your company or organization has already enrolled, because duplicate enrollments will slow down the process considerably. The E-Verify government website, www.uscis.gov/E-Verify, will give you complete instructions on how to prepare, enroll, and administer the program. While E-Verify is relatively easy to use, there is some preparatory work that will have to be done by you and your business. Key pieces include deciding which of your company's hiring sites will participate, determining your "verification" locations, and deciding who in your company will need to access the E-Verify system. Since the program is internet based, you need to have a computer with internet access and a printer to print various forms, publications, and notices.
The first step in verifying an employee's identity and working status is the Form I-9 which both the employee and employer are required to complete. With the E-Verify system, the employer takes the employees Form I-9 info and enters it into E-Verify. The system will then match the newly hired employee's social security number and other Form I-9 information with records stored by the Dept. of Homeland Security and the Social Security Administration.
While participation in E-Verify is voluntary for most businesses and organizations, some companies (federal contractors and subcontractors) are required to use it. And many states now have laws that require the use of E-verify. Gov. Bobby Jindal just signed two new bills into law which will require employers to "get on board" with the E Verify system. House Bill 342 requires private contractors who want to do business with either a state or public entity to use E-Verify while House Bill 646 requires private businesses to use the same system or face fines for employing illegal immigrants.
Frazee Recruiting Consultants has been using E-Verify for over a year now. "It's effective and easy to use," says Frazee Operations Manager, Jeff Pruitt. "E-Verify is one government program that actually helps, instead of hinders, a small business's operations."
